Terms of Service

1. Agreement to Terms

By accessing or using Oncall (“the Service”), operated by Oncall (“we,” “us,” or “our”), you (“Customer” or “you”) agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Oncall is a software as a service tool that integrates with Follow Up Boss to enable shift based lead routing for real estate teams. We are not affiliated with, endorsed by, or sponsored by Follow Up Boss, Boston Logic Technology Partners, Inc., Google LLC, or any other third party platform we integrate with.

3. Account Registration

To use the Service, you must register an account, provide accurate information, and keep your credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old and authorized to bind your brokerage to these Terms.

4. Subscription and Payment

Oncall is offered on a paid subscription basis at the rate posted on our website (currently $150 per month per team, with a free first month for new teams). A payment method is collected at signup; you are not charged until the free month ends, and you may cancel any time before then at no cost. Subscription fees are billed in advance and are nonrefundable except as required by law. We may change pricing with 30 days’ notice; changes apply to your next billing period after notice.

5. Cancellation

You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial periods.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Reverse engineer, decompile, or attempt to extract source code from the Service.
  • Resell, sublicense, or repackage the Service without our written permission.
  • Send spam or unsolicited communications via Oncall, or use integrations to violate any third party platform’s terms (including Follow Up Boss, Google, Resend).
  • Probe, scan, or test the vulnerability of the Service without authorization.
  • Interfere with or disrupt the Service or servers connected to it.

7. Customer Data

You retain all rights to data you provide to Oncall and data we sync from your connected Follow Up Boss account (“Customer Data”). You grant us a limited license to process Customer Data solely to operate the Service for you.

You are responsible for ensuring you have the right to share Customer Data with us, including any necessary consents from your team members.

8. Intellectual Property

All software, designs, logos, trademarks, and content of the Service (other than Customer Data) are owned by Oncall or its licensors. We grant you a limited, nonexclusive, nontransferable license to use the Service during the term of your subscription.

9. Third Party Integrations

Oncall integrates with Follow Up Boss, Google Calendar, Resend, and others. Your use of those integrations is subject to those providers’ own terms. We are not responsible for the availability, accuracy, or reliability of any third party service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, FREE OF ERRORS, OR MEET YOUR REQUIREMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONCALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Oncall and its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (e.g., Intellectual Property, Limitation of Liability, Indemnification) will continue to apply.

14. Governing Law

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Utah County, Utah, and you consent to the exclusive jurisdiction of those courts.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
